Work is currently conducted on the amendment to the Polish Labor Code, which will comprehensively regulate and permanently introduce the possibility of remote work.
It should be noted that in the latest draft, the Ministry changed the rules for the return of the employee to onsite work as follows.
In the earlier draft amendment, both the employer and the employee had three months from starting remote work to decide to resign from it. After this deadline, when the employee demonstrated such a willingness, the employer could (but was not obliged) to consider the employee's request "as far as possible", which was related to the consent of the employer.
In the latest project, the employee will have an unlimited time option to submit an application binding for the employer to end remote work. After 30 days, he will return to work in the office.
Such regulation of the provisions of returning to onsite work may raise some organizational problems related to the planning of office space, however, work on the project is still ongoing and it is not certain that the above project will come into force.
