On 7 October 2020, the Sejm adopted the act on electronic delivery of correspondence. The purpose of the act is a simple and transparent electronic communication between the state administration and citizens.
The Sejm has adopted the law which according to the Ministry of Digital Affairs will allow better communication with the Polish authorities. Everything will be done online, regardless of where the taxpayer is located. Electronic delivery will give this possibility and its purpose is to facilitate the delivery and sending of correspondence by e-mail, without the need to go to the post office. Electronic delivery will be legally equivalent to sending a traditional registered letter with acknowledgment of receipt or personal delivery. The electronic delivery service will be voluntary and free.
The law provides that a citizen has an address for all communications with the administration, an email box which will be used for the exchange of electronic correspondence with offices. In practice, it will function like a traditional email box, but it will be adequately protected. For the purpose of electronic delivery, a new public register will be created, called “Baza adresów elektronicznych” (Electronic address database). Entering an e-mail address in this database obliges public entities to deliver letters to this address.
For citizens who do not use digital technologies, a hybrid public service is planned that will allow the complete digitalization of the process of sending/receiving correspondence by public entities and entrepreneurs, leaving citizens to choose the form of sending/delivery (paper or electronic form). It consists in the processing of correspondence sent electronically into paper format and its delivery in that form, or in the sending of correspondence in paper format, then in its processing into electronic format and finally in the delivery in this form.
