Remote work will be permanently regulated in the Polish Labour Code – legislative work is currently being undertaken at the Ministry of Development, Labour and Technology.
According to the preliminary assumptions, remote work may be performed at the employer’s request (the provisions include particular situations that justify such request) or at the employee’s request – as a rule non-binding for the employer – 12 days per calendar year. The employee’s request will be binding for the employer only in case of particular and clearly enlisted groups of employees, e.g., employees who are parents of children under 4, parents of children with disabilities, etc.
In order to introduce remote work in a workplace, it is essential to draw up regulations of remote work or an agreement with trade unions.
The new provisions will more precisely regulate matters related to materials, tools and costs of remote work, as well as other duties of employers and employees related to remote work.
Experts believe that remote work in this shape may be an interesting opportunity for foreign entrepreneurs who do not have a permanent headquarters in Poland, since the communication with employees under remote work will take place in electronic form.
