On 1 June 2025, the Act on the conditions for admitting foreigners to employment in the territory of the Republic of Poland (Official Journal 2025, item 621) entered into force. Among other things, this Act provides for the creation of a list of entrepreneurs conducting economic activities of importance to the national economy in the territory of the Republic of Poland.
Pursuant to Article 28(1) of the aforementioned Act, the list covers enterprises receiving government support for new investments, based on one of the following three forms of support:
Decision on support under the Act of 10 May 2018 on support for new investments.
Grant agreement under the Programme for Support for Investments of Significant Importance for the Polish Economy for the period 2011-2030.
Support agreement under the Regulation of the Minister of Development and Technology of 29 September 2023 on the granting of State aid for the implementation of investment projects of strategic importance for the transition to a net-zero emissions economy.
The list authorises the territorially competent Voivoda to examine the applications of the above-mentioned entrepreneurs as a matter of priority.
The list is updated automatically on the date of issue of one of the support decisions or on the date of conclusion of the grant or support agreement.
This is an important new incentive for companies benefiting from government support for new investments in Poland.
